These Terms of Service (“Terms”) govern the use of the site, checkout, APIs, dashboard, and other functionalities provided by Mundpay (“Services
you agree to these Terms and the Complementary Policies mentioned below, which are an integral part of these Terms.
Mundpay acts as Merchant of Record (MoR) and authorized reseller for transactions processed via checkout. When finalizing an order, you (Buyer) purchase from Mundpay; Mundpay acquires from the Seller (provider) and resells the Product, issuing applicable tax documentation according to the jurisdiction.
1. Mundpay Entities and Contacts
Depending on the Transaction and jurisdiction, the Mundpay counterparty will be one of the companies listed below:

2. Definitions
Buyer/Customer: individual/legal entity that purchases a Product via Mundpay checkout.
Seller/Provider: individual/legal entity that supplies Product to Mundpay for resale.
Product: physical good (material, with logistics) or digital good (download, key/license, SaaS, cloud/streaming content).
Transaction: purchase completed via Services.
Subscription: recurring supply with periodic charge.
Complementary Policies: (i) Privacy Policy; (ii) Refund, Return, and Cancellation Policy; (iii) Prohibited Products Policy; (iv) Acceptable Use Policy (AUP); (v) Advertising & Media Policy; (vi) Payments & Fees (payouts, reserves, schedules).
Customer Portal: order.mundpay.com (manage orders, refunds, subscriptions).
3. Nature of the Services and MoR Role
3.1 Formation of the contract. When finalizing the checkout, the Buyer makes a purchase offer. The purchase and sale contract is considered formed when Mundpay sends the order confirmation (receipt/email). From then on, Mundpay is the seller to the Buyer, acting as MoR.
3.2 Ownership and risk.
Physical Products: unless provided otherwise by law, ownership transfers to the Buyer upon shipping; the risk of loss transfers upon delivery to the specified address.
Digital Products: the granting of usage rights occurs upon access release/activation (download, key, login, streaming). By starting a download/streaming/activation, the Buyer consents to begin execution and acknowledges that they may lose the right of withdrawal/retraction according to the laws of their jurisdiction.
3.3 Relationship with the Seller. Mundpay acquires from the Seller and resells to the Buyer. The Seller remains responsible for content, quality, compliance, support, and fulfillment of the Product (physical and digital), in accordance with the Complementary Policies.
3.4 Eligibility. You declare that you are of legal age or have valid authorization from a legal guardian and are capable of entering into contracts.
4. Accounts, Verification, and Security
4.1 Correct data. Account information must be true, complete, and up to date; keep credentials confidential.
4.2 KYC/KYB. Mundpay may require identity/company verification (corporate documents, UBOs, PEP, sanctions) and use specialized providers.
4.3 Anti-fraud. We may employ 3DS, automatic/manual reviews, pre-authorization of amounts, temporary blocking/suspension of orders or accounts in case of risk.
5. Prices, Taxes, Payments, and Invoices
5.1 Prices and coupons. Prices may vary until the order is completed; coupons/discounts apply according to the offer rules.
5.2 Taxes. Where applicable, Mundpay may calculate, collect, and remit indirect taxes (e.g., VAT/IVA/GST/Sales Tax). Import/customs charges (if any) may be the responsibility of the Buyer.
5.3 Electronic invoices/receipts. The Buyer authorizes the receipt of electronic tax documents. Companies may provide tax IDs (e.g., VAT ID) for proper issuance.
5.4 Billing and descriptor. Billing may appear on the statement as “MUNDPAY{PRODUCT/STORE}”* (or “MUNDPAY”).
5.5 Currency and exchange. The currency of billing/conversion may vary by country. Exchange rates and variances are the responsibility of the Buyer's issuer/bank.
6. Delivery, Access, and Fulfillment
6.1 Physical Products. The Seller is responsible for packaging, shipping, tracking, and RMA (return authorization), as well as for timelines, exchanges, and replacements. In case of incorrect/damaged items, contact the Customer Portal for instructions.
6.2 Digital Products. Delivery via email/dashboard/supplier account, with immediate access when applicable. If there is an access/activation failure not resolved within a reasonable time, Mundpay may offer replacement or refund according to the Refund Policy.
6.3 Preorders/Backorders. Availability dates are estimates; relevant delays may entitle refund.
7. Subscriptions, Trials, and Renewal
7.1 Automatic renewal. Subscriptions renew until canceled by the Buyer.
7.2 Cancellation. To avoid the next charge, cancel with reasonable advance notice (we recommend 48h) at order.mundpay.com.
7.3 Free trial. Cancel before the end of the trial to avoid the first charge.
7.4 Price changes. We may update subscription amounts; when required, there will be prior notice and/or consent.
8. Refund, Return, and Cancellation (summary)
8.1 Standard window (unless more favorable condition on the sales page):
Physical: up to 30 calendar days after delivery.
Digital (single): up to 7 calendar days after purchase.
Subscriptions (1st charge): up to 7 calendar days; renewals are, as a rule, non-refundable after the charge (unless error/duplication/access failure).
8.2 Process. Use order.mundpay.com (or help@mundpay.com). For Physical, wait for RMA and, when applicable, return label.
8.3 Refund method. Exclusively to the original method; credit may appear in 1–2 billing cycles.
8.4 Exceptions. Redeemed keys/licenses, missing items or damages from misuse may reduce/prevent refund. Complete rules in the Refund Policy.
9. Buyer Conduct
It is prohibited: (a) fraudulent use of the card/account; (b) abuse of chargebacks; (c) social engineering; (d) violation of IP; (e) deceptive/illegal practices. Mundpay may deny/cancel orders, restrict accounts, and contest baseless disputes.
10. Seller Obligations (summary)
Sellers operating through Mundpay agree that:
(a) they hold rights over Products and content, without infringing on third-party IP;
(b) they comply with sector laws, labeling/safety/approval/warranty requirements;
(c) they provide post-sale support and honor refunds;
(d) they adhere to AUP, Prohibited Products, Advertising & Media;
(e) they provide tax data/documents when requested;
(f) they do not use dark patterns, “guaranteed” promises, or cloaking.
In case of violation/risk, Mundpay may remove listings, suspend accounts, withhold amounts, and apply risk reserve.
11. Payments to Sellers, Reserves, and Offsets
11.1 Payouts. Mundpay passes through net amounts according to the schedule and currency displayed in the dashboard, deducting fees, refunds, chargebacks, and adjustments.
11.2 Reserves (rolling reserve) and withholdings. Mundpay may withhold percentages/amounts and/or defer payments to mitigate fraud, chargebacks, returns, and network penalties.
11.3 Set-off and negative balance. Mundpay may offset amounts owed with Seller balances; any negative balances must be replenished immediately.
11.4 Evidence. Mundpay may require proof of delivery, access logs, and support history for defense in disputes.
12. Acceptable Use, Advertising, and Prohibited Products
12.1 Acceptable Use Policy (AUP). It is prohibited to use the Services for illegal, deceptive, or dangerous purposes.
12.2 Advertising & Media. Ads, landing pages, and funnels must be clear, truthful, and consistent with the checkout (cloaking, misleading redirects, unrealistic promises, and irregular data collection are prohibited).
12.3 Prohibited Products. It is prohibited to sell prohibited items (e.g., drugs, weapons, child pornography, illegal schemes, counterfeits, personal databases without legal basis). Violation authorizes immediate removal, retention of amounts, and termination.
13. Regulatory Compliance (Sanctions, Export, AML/CFT)
13.1 Sanctions. You declare that you are not on sanction lists (e.g., OFAC/UN/EU), do not operate in embarged jurisdictions, and do not use the Services to circumvent them.
13.2 Export controls. For items/software with restrictions, the Seller must comply with export/reexport controls; the Buyer shall not export/reattribute unlawfully.
13.3 AML/CFT. Mundpay may monitor, report, block amounts, and terminate accounts in the presence of suspicious activities or legal requirements.
13.4 Anti-corruption. It is prohibited to offer/accept undue advantages related to the Services.
14. Intellectual Property and Third-Party Content
14.1 Mundpay. Software, brands, layouts, interfaces, and contents of the Services are protected by copyright and other laws. No license is granted beyond authorized use.
14.2 Third-party content and links. May be provided "as is"; Mundpay is not responsible for external content.
14.3 Infringement notification. Reports of IP violation may be sent to help@mundpay.com with supporting documentation.
15. Privacy, Data, and Security
15.1 Privacy Policy. The processing of personal data will follow the Mundpay Privacy Policy.
15.2 Accelerated checkout (one-click). We may offer quick checkout with payment tokenization, upon consent, revocable at order.mundpay.com.
15.3 Security. We adopt reasonable administrative, technical, and physical measures; no system is 100% secure. The user must protect devices and passwords.
16. Warranties, Disclaimers, and Limitations
16.1 No comprehensive warranties. The Services are provided “as is” and “as available,” without express/implicit warranties regarding performance, suitability, or non-infringement.
16.2 Limitation of liability. To the fullest extent permitted, Mundpay is not liable for indirect, special, punitive or consequential damages. Where applicable, Mundpay’s liability cap is limited to the total fees paid to Mundpay in the 12 months prior to the event.
16.3 Third-party content and descriptions. Mundpay does not guarantee the accuracy of descriptions and claims from Sellers.
17. Modifications, Suspension, and Termination
17.1 Updates. We may update these Terms and the Policies; relevant changes will be communicated prominently. Continued use implies acceptance.
17.2 Enforcement. Mundpay may suspend/terminate accounts, remove content, withhold funds, and deny orders in cases of material violation/risk.
17.3 Force majeure. Mundpay is not liable for failures resulting from events beyond reasonable control (e.g., network outages, disasters, government acts).
18. Dispute Resolution, Governing Law, and Forum
18.1 U.S. Consumers (when applicable). Disputes between you and Mundpay relating to these Terms or the Services may be resolved by binding individual arbitration and waiver of class actions, according to rules and provider that will be indicated in the dispute notice (e.g., AAA/JAMS), without prejudice to small claims when applicable.
18.2 Other countries. Unless local mandatory regulations apply, the law and forum of the Mundpay entity processing the Transaction will apply.
18.3 Deadline. When allowed by law, claims must be submitted within 1 (one) year from the triggering event.
19. General Provisions
19.1 Assignment. Mundpay may assign/transfer this agreement, in whole or in part, to affiliates/successors; the user may not assign without written consent.
19.2 Clause autonomy. The invalidity of any provision will not affect the remaining provisions.
19.3 No waiver. The failure to exercise a right does not imply waiver.
19.4 Entire agreement. These Terms and the Complementary Policies constitute the entire agreement between you and Mundpay regarding the Services.
19.5 Notifications. They will be valid if sent to the contacts provided in the account or published in the Services.
19.6 Languages. In the event of a discrepancy between this version and the English version, the version indicated by Mundpay on the legal pages may prevail.

3. Nature of the Services and MoR Role
3.1 Formation of the contract. When finalizing the checkout, the Buyer makes a purchase offer. The purchase and sale contract is considered formed when Mundpay sends the order confirmation (receipt/email). From then on, Mundpay is the seller to the Buyer, acting as MoR.
3.2 Ownership and risk.
Physical Products: unless provided otherwise by law, ownership transfers to the Buyer upon shipping; the risk of loss transfers upon delivery to the specified address.
Digital Products: the granting of usage rights occurs upon access release/activation (download, key, login, streaming). By starting a download/streaming/activation, the Buyer consents to begin execution and acknowledges that they may lose the right of withdrawal/retraction according to the laws of their jurisdiction.
3.3 Relationship with the Seller. Mundpay acquires from the Seller and resells to the Buyer. The Seller remains responsible for content, quality, compliance, support, and fulfillment of the Product (physical and digital), in accordance with the Complementary Policies.
3.4 Eligibility. You declare that you are of legal age or have valid authorization from a legal guardian and are capable of entering into contracts.
4. Accounts, Verification, and Security
4.1 Correct data. Account information must be true, complete, and up to date; keep credentials confidential.
4.2 KYC/KYB. Mundpay may require identity/company verification (corporate documents, UBOs, PEP, sanctions) and use specialized providers.
4.3 Anti-fraud. We may employ 3DS, automatic/manual reviews, pre-authorization of amounts, temporary blocking/suspension of orders or accounts in case of risk.
5. Prices, Taxes, Payments, and Invoices
5.1 Prices and coupons. Prices may vary until the order is completed; coupons/discounts apply according to the offer rules.
5.2 Taxes. Where applicable, Mundpay may calculate, collect, and remit indirect taxes (e.g., VAT/IVA/GST/Sales Tax). Import/customs charges (if any) may be the responsibility of the Buyer.
5.3 Electronic invoices/receipts. The Buyer authorizes the receipt of electronic tax documents. Companies may provide tax IDs (e.g., VAT ID) for proper issuance.
5.4 Billing and descriptor. Billing may appear on the statement as “MUNDPAY{PRODUCT/STORE}”* (or “MUNDPAY”).
5.5 Currency and exchange. The currency of billing/conversion may vary by country. Exchange rates and variances are the responsibility of the Buyer's issuer/bank.
6. Delivery, Access, and Fulfillment
6.1 Physical Products. The Seller is responsible for packaging, shipping, tracking, and RMA (return authorization), as well as for timelines, exchanges, and replacements. In case of incorrect/damaged items, contact the Customer Portal for instructions.
6.2 Digital Products. Delivery via email/dashboard/supplier account, with immediate access when applicable. If there is an access/activation failure not resolved within a reasonable time, Mundpay may offer replacement or refund according to the Refund Policy.
6.3 Preorders/Backorders. Availability dates are estimates; relevant delays may entitle refund.
7. Subscriptions, Trials, and Renewal
7.1 Automatic renewal. Subscriptions renew until canceled by the Buyer.
7.2 Cancellation. To avoid the next charge, cancel with reasonable advance notice (we recommend 48h) at order.mundpay.com.
7.3 Free trial. Cancel before the end of the trial to avoid the first charge.
7.4 Price changes. We may update subscription amounts; when required, there will be prior notice and/or consent.
8. Refund, Return, and Cancellation (summary)
8.1 Standard window (unless more favorable condition on the sales page):
Physical: up to 30 calendar days after delivery.
Digital (single): up to 7 calendar days after purchase.
Subscriptions (1st charge): up to 7 calendar days; renewals are, as a rule, non-refundable after the charge (unless error/duplication/access failure).
8.2 Process. Use order.mundpay.com (or help@mundpay.com). For Physical, wait for RMA and, when applicable, return label.
8.3 Refund method. Exclusively to the original method; credit may appear in 1–2 billing cycles.
8.4 Exceptions. Redeemed keys/licenses, missing items or damages from misuse may reduce/prevent refund. Complete rules in the Refund Policy.
9. Buyer Conduct
It is prohibited: (a) fraudulent use of the card/account; (b) abuse of chargebacks; (c) social engineering; (d) violation of IP; (e) deceptive/illegal practices. Mundpay may deny/cancel orders, restrict accounts, and contest baseless disputes.
10. Seller Obligations (summary)
Sellers operating through Mundpay agree that:
(a) they hold rights over Products and content, without infringing on third-party IP;
(b) they comply with sector laws, labeling/safety/approval/warranty requirements;
(c) they provide post-sale support and honor refunds;
(d) they adhere to AUP, Prohibited Products, Advertising & Media;
(e) they provide tax data/documents when requested;
(f) they do not use dark patterns, “guaranteed” promises, or cloaking.
In case of violation/risk, Mundpay may remove listings, suspend accounts, withhold amounts, and apply risk reserve.
11. Payments to Sellers, Reserves, and Offsets
11.1 Payouts. Mundpay passes through net amounts according to the schedule and currency displayed in the dashboard, deducting fees, refunds, chargebacks, and adjustments.
11.2 Reserves (rolling reserve) and withholdings. Mundpay may withhold percentages/amounts and/or defer payments to mitigate fraud, chargebacks, returns, and network penalties.
11.3 Set-off and negative balance. Mundpay may offset amounts owed with Seller balances; any negative balances must be replenished immediately.
11.4 Evidence. Mundpay may require proof of delivery, access logs, and support history for defense in disputes.
12. Acceptable Use, Advertising, and Prohibited Products
12.1 Acceptable Use Policy (AUP). It is prohibited to use the Services for illegal, deceptive, or dangerous purposes.
12.2 Advertising & Media. Ads, landing pages, and funnels must be clear, truthful, and consistent with the checkout (cloaking, misleading redirects, unrealistic promises, and irregular data collection are prohibited).
12.3 Prohibited Products. It is prohibited to sell prohibited items (e.g., drugs, weapons, child pornography, illegal schemes, counterfeits, personal databases without legal basis). Violation authorizes immediate removal, retention of amounts, and termination.
13. Regulatory Compliance (Sanctions, Export, AML/CFT)
13.1 Sanctions. You declare that you are not on sanction lists (e.g., OFAC/UN/EU), do not operate in embarged jurisdictions, and do not use the Services to circumvent them.
13.2 Export controls. For items/software with restrictions, the Seller must comply with export/reexport controls; the Buyer shall not export/reattribute unlawfully.
13.3 AML/CFT. Mundpay may monitor, report, block amounts, and terminate accounts in the presence of suspicious activities or legal requirements.
13.4 Anti-corruption. It is prohibited to offer/accept undue advantages related to the Services.
14. Intellectual Property and Third-Party Content
14.1 Mundpay. Software, brands, layouts, interfaces, and contents of the Services are protected by copyright and other laws. No license is granted beyond authorized use.
14.2 Third-party content and links. May be provided "as is"; Mundpay is not responsible for external content.
14.3 Infringement notification. Reports of IP violation may be sent to help@mundpay.com with supporting documentation.
15. Privacy, Data, and Security
15.1 Privacy Policy. The processing of personal data will follow the Mundpay Privacy Policy.
15.2 Accelerated checkout (one-click). We may offer quick checkout with payment tokenization, upon consent, revocable at order.mundpay.com.
15.3 Security. We adopt reasonable administrative, technical, and physical measures; no system is 100% secure. The user must protect devices and passwords.
16. Warranties, Disclaimers, and Limitations
16.1 No comprehensive warranties. The Services are provided “as is” and “as available,” without express/implicit warranties regarding performance, suitability, or non-infringement.
16.2 Limitation of liability. To the fullest extent permitted, Mundpay is not liable for indirect, special, punitive or consequential damages. Where applicable, Mundpay’s liability cap is limited to the total fees paid to Mundpay in the 12 months prior to the event.
16.3 Third-party content and descriptions. Mundpay does not guarantee the accuracy of descriptions and claims from Sellers.
17. Modifications, Suspension, and Termination
17.1 Updates. We may update these Terms and the Policies; relevant changes will be communicated prominently. Continued use implies acceptance.
17.2 Enforcement. Mundpay may suspend/terminate accounts, remove content, withhold funds, and deny orders in cases of material violation/risk.
17.3 Force majeure. Mundpay is not liable for failures resulting from events beyond reasonable control (e.g., network outages, disasters, government acts).
18. Dispute Resolution, Governing Law, and Forum
18.1 U.S. Consumers (when applicable). Disputes between you and Mundpay relating to these Terms or the Services may be resolved by binding individual arbitration and waiver of class actions, according to rules and provider that will be indicated in the dispute notice (e.g., AAA/JAMS), without prejudice to small claims when applicable.
18.2 Other countries. Unless local mandatory regulations apply, the law and forum of the Mundpay entity processing the Transaction will apply.
18.3 Deadline. When allowed by law, claims must be submitted within 1 (one) year from the triggering event.
19. General Provisions
19.1 Assignment. Mundpay may assign/transfer this agreement, in whole or in part, to affiliates/successors; the user may not assign without written consent.
19.2 Clause autonomy. The invalidity of any provision will not affect the remaining provisions.
19.3 No waiver. The failure to exercise a right does not imply waiver.
19.4 Entire agreement. These Terms and the Complementary Policies constitute the entire agreement between you and Mundpay regarding the Services.
19.5 Notifications. They will be valid if sent to the contacts provided in the account or published in the Services.
19.6 Languages. In the event of a discrepancy between this version and the English version, the version indicated by Mundpay on the legal pages may prevail.
